PROCEDURAL HISTORY This suit was originally filed on June 18, 1993, in the circuit court of Shelby County, Tennessee, but was dismissed for lack of jurisdiction. Thereafter, the suit was refiled in the Circuit Court of Desoto County, Mississippi, and later transferred to the County Court of Desoto County, Mississippi, for trial.

Prior to the case's being transferred to the county court, Circuit Judge Andrew Baker entered partial summary judgment limiting the Plaintiff's/Appellant's recovery to any damages to the three year period immediately preceding filing of the suit in Tennessee.
