This is an appeal of the trial court's decision to dismiss Henry Hook as a defendant in a personal injury action filed against him and Donell Morgan, Sr. in the Circuit Court of Lee County. The suit arose out of a motor vehicle accident that occurred in the State of Alabama. Hook, the driver of one vehicle, is a resident of Alabama without any demonstrated business or contractual connections with Mississippi. Morgan, the driver of the other vehicle, is a resident of Lee County. The plaintiffs bringing this appeal are Morgan's wife and children, who were passengers in the vehicle driven by Morgan at the time of the accident.
Hook successfully sought dismissal as a co-defendant by motion filed under Mississippi Rule of Civil Procedure 12(b), claiming that he was not subject to in personam jurisdiction of the courts of this State ...
